Description
Section 118 of the Strata Schemes Management Act 2015 (NSW) and clause 30 of the Strata Schemes Management Regulation 2016 (NSW) require residential strata schemes to ensure that window safety devices are installed on certain windows to prevent children falling from windows.
Window safety devices ensure that the openings of windows are restricted to 12.5cm when the devices are engaged.
This by-law confirms the Owners Corporation’s responsibility to install window safety devices and makes lot owners responsible for notifying the Owners Corporation should those devices require repair or replacement. The by-law also sets out the requirement for occupiers to provide access and provides an avenue for the Owners Corporation to recovery any penalty/fine from the lot owner in the event of non-compliance.
