Hi we have an apartment in the North Sydney Council area who recently challenged an AirBnB occupation in court and lost. We have 3 owners in our building who are utilising AirBnB and the owner/occupiers are experiencing a downturn in the quality of life here. We are happy to take whatever steps to ban Short term let’s. Can you assist us?
We have a unit in Kiribilli, some owners utilising AirBnB which is undermining quality of life. Strata have banned short term let’s but these owners have ignored and continued the practise. We are wishing to challenge, in court, if necessary. Can you advise?
Hi Marie, when you say “strata have banned short term lets” I assume you mean there is a by-law in place and these owners are letting in breach of the by-law? If so, then your owners corporation needs to enforce their by-law. There are a couple of ways to do this, including issuing a “notice to comply” under the NSW legislation, followed by a Tribunal order imposing a penalty against the owner/s. Your building would be well placed to obtain some specific legal advice. You’re welcome to reach out to my team here: enquiries@lawyerschambers.com.au
