Hi, Would you please help me understand who is responsible for bathroom exhaust fans.
This fan services one unit only.
It is partly installed inside the ceiling and partly outside.

Because exhaust fans servicing bathrooms are generally connected to a building wide ventilation system, they are the responsibility of the Owners Corporation.
There may be a situation where the fan is not in any way connected to a system servicing others (for example – a top floor unit venting straight to the roof). Then that fan is the lot owner’s responsibility.
In NSW, the key point to determine is where the item is “for the exclusive benefit of the lot”. When connected to a common system servicing other lots, the fan is not for the exclusive benefit of the lot.
