Hi Amanda
I am living in a strata property in NSW.
Can we permanently ban a person from acting for strata committee again?
Regards

Where one owner (Ms X) owns 50 per cent lot entitlements and the other half of the OC don’t support Ms X being on the strata committee, how can this issue be resolved?

The process of electing the strata committee at an AGM is as follows:
1. call for nominations
2. set the number
3. if the number of nominations exceeds the number of positions available, there is an election.
So, if Ms X nominates and 50% of owners don’t want her on the committee, then ensure that others do nominate and try to set the number of committee members at one less than the number of nominees.
Example: you have 5 people nominate (including Ms X). Set the number of committee members at 4. You must then have an election. If no one votes for Ms X, she will not get on the committee.
Does that help?
Amanda.
