Description
An owners corporation may find itself having to make an urgent interim application to the NSW Civil and Administrative Tribunal (NCAT) when a lot owner commences or has completed unapproved renovation work affecting the common property (as discussed in Podcast Episode No. 426). Where such an application has been made by an owners corporation, it may wish to consider allowing time for the owner to produce a suitable by-law to enable retrospective approval of the work. In those circumstances, these sample consent orders can be proposed as a neat solution to the interim application. They also include a standard set of directions should the by-law proposed by the lot owner not be successful, and the application need to proceed to a final hearing.
