I understood (perhaps from yet more misinformation) that an Owner couldn’t get compensation from an OC for contents damage caused by defective Common property unless the OC could be found negligent i.e. having some reasonable means of predicting the breakage and it’s likely effects. Is this referring to the newish notion that original floor coverings are CP – at least for purposes of compensation similar to this case?

      If you’re in NSW, then sadly you have been misinformed. But (also sadly), you’re not the only one.

      I hear this often – usually from strata managers: the owners corporation isn’t liable for lot property damage unless they have been negligent. Time and again our Tribunal and Courts have said that’s just not the case.

      Social media can be a great place to look for opinions and anecdotal experiences from other people however it should not be the final stop in sourcing accurate information.

  2. I hear interviews with OCN members but who are they ? I have been in many owner corporations over the years but have never heard of this group or been asked to join.
    How can they claim to be represent owners but they seem to be a group with no members.

    I am very upset with the way some Strata Managers and committee members treat our Homes and there is nothing we can’t do because we do not have proper Consumer Protection in Housing but instead has become a Ponzy Scheme where the first investors got Millions, Billions on their Investment and the people who wanted a Home are left with the cost of high Strata Levies to fix their rotten ways
    I have been reading Jan Newland booklets “Strata beneath the surface” and believe is the best value for money if we want to be informed., and believe that Strata Managers and Fair Trading should read them if they are interested in people having a place to live.
